As noted before, Jeff Hardy was arrested this past June in Volusia County, Florida following a drunk driving incident. Hardy has been out of action for AEW since that time due to his current suspension over his DUI arrest.
The Wrestling Observer’s Josh Nason reported that the legal case against Hardy was officially closed on Thursday following Hardy submitting a written plea of nolo contendere to all of the charges against him, based on recent court records. Nason reported that a plea of nolo contendrere means that Hardy agreed to accept a punishment from the court in return for him not accepting nor denying responsibility for the charges against him.
The court reportedly ruled for Hardy’s driver’s licenses to be suspended for ten years and to be given 38 days credit for time served in county jail as part of the sentence against him. This sentence reportedly also included two years probation, $4,586 in fines and court fees, community service, and to enter a court-mandated DUI school or drug rehab program.
Prior to the sentencing, Hardy’s lawyer reportedly had filed a motion to the court this past Tuesday requesting for the breathalyzer tests performed on him during his arrest to be ruled as unreliable due to issues over how it was handled. Specially the motion argued:
Mr. Hardy’s breath tests did not comply with FDLE’s requirements established in FDLE’s administrative rules to ensure reliable quantitative breath tests.
There is insufficient probative evidence that the breath tests in Mr. Hardy’s case were performed substantially in accordance with methods approved by FDLE and with a compliant machine approved by FDLE.
For the above reasons, this Court should enter an order excluding any evidence of a breath test and breath test results obtained in this case.
While Hardy’s legal case over his DUI arrest has been officially closed, the status of Hardy’s future in AEW is currently not known.
