Ryan Nemeth Lawsuit Against AEW, Tony Khan, & CM Punk Over Breach of Contract & Alleged Assault Claims Update – AEW & Khan File Petition for Private Arbitration

As noted before, former AEW and current TNA talent Ryan Nemeth filed a lawsuit this past February against AEW, AEW CEO Tony Khan, and CM Punk over claims of assault was committed against him by Punk and breach of contract, breach of implied covenant of good faith and fair dealing and intentional interference with prospective advantage by AEW and Khan.

Post Wrestling and Wrestlenomics’ Brandon Thurston reported that AEW and Khan filed a petition on Friday before the United States District Court in the Middle District of Florida requesting for the lawsuit to be moved into private arbitration.

In their filing, AEW and Khan are claiming that Nemeth’s claims should be adjudicated through private arbitration rather than in public in court. The filing also stated that Nemeth had signed three contracts with AEW and each contract contained identical arbitration clauses that any disputes be resolved in Duval County, Florida, under JAMS, Inc. arbitration rules.

In the filing, AEW and Khan did not name Punk as a party for their petition.

AEW and Khan also claimed that Nemeth has “ignored his contractual obligations and binding authority requiring arbitration” by filing a lawsuit in Los Angeles County. AEW and Khan are currently asking for the federal court to enforce the arbitration clause, direct him to pursue his claims in arbitration, and also require Nemeth to pay for the attorneys’ fees that AEW is incurring by bringing their petition to court.

In the filing, AEW claimed that the language of Nemeth’s contract states:

“[a]ll disputes between [Nemeth] and AEW, including, without limitation, any dispute relating to any matter arising under this Agreement or any dispute concerning the performance, application or interpretation of any provision of this Agreement, shall be resolved for final, binding, and conclusive arbitration conducted before a single arbitrator in Duval County, Florida and administered by JAMS, Inc. pursuant to its Comprehensive Arbitration Rules and Procedures.”

Thurston reported that AEW currently intends to file Nemeth’s contracts under seal “due to the Confidentiality provision in each of the agreements” similar to the other contracts in Kevin Kelly and The Tate Twins lawsuit against them.
