David Otunga and his fiancé Jennifer Hudson have split up after 10 years together and Hudson has been granted a restraining order, which Otunga claims was filed because she’s afraid of losing custody of their son.
Jennifer Hudson’s rep told People:
“They have been in the process of ending their relationship for a number of months.
Today, Jennifer requested and received a protective order against her ex-fiancé. Jennifer’s actions are solely taken in the best interest of their son.”
TMZ obtained the order of protection that Hudson got and were told that police were opening a domestic battery investigation.
TMZ has obtained the order of protection Hudson got Thursday. She claims David has exhibited “aggressive, threatening and harassing behavior toward me.” She says, “I am now living in fear of further action David might take.”
She claims on Wednesday she was at a recording session in Chicago with their son, David Jr., and David made a series of phone calls to reach her. When he couldn’t get her, he asked their son to record the scene. Hudson says David wanted their son to show she was dating one of her producers … something she denies.
She says when she got home David was visibly angry, grabbed David Jr. by the hand and physically pushed Hudson out of the master suite. She claims their son, a makeup artist and an assistant all witnessed the incident.
David Otunga’s attorney, Tracy Mr. Rizzo put out this statement to People, saying that Hudson was making false allegations and that he has never abused or harassed her:
“Mr. Otunga has never abused or harassed Ms. Hudson or their son, and it is unfortunate, especially in today’s climate, that she would feel the need to make these false allegations against him. Mr. Otunga looks forward to his day in court and in being awarded the residential care of the parties’ only child.”
Otunga’s attorney also told TMZ:
“David Otunga has been trying to negotiate the terms of an amicable parenting agreement with Ms. Hudson for several weeks now. However, when it became apparent to Ms. Hudson that Mr. Otunga would be the parent granted residential care of the child, as a result of Mr. Otunga being the child’s primary caregiver while Ms. Hudson pursues her career all over the world, Ms. Hudson decided to file a meritless Petition for Order of Protection in an effort to gain an unfair advantage in the custody dispute. As a result of Mr. Otunga’s career in the WWE, Ms. Hudson felt that she could give an award winning performance in court to portray herself as the victim. Mr. Otunga has never abused or harassed Ms. Hudson or their son.”
A later statement from Otunga’s attorney added:
“At no time did Mr. Otunga ‘physically push’ Ms. Hudson as she has alleged.”
TMZ also reported that Otunga has pulled out of the Survivor Series Kickoff panel that he was scheduled to be on this Sunday.
Sources close to Otunga tell us he wants to focus on the intense child custody fight with Jennifer Hudson … and decided to pull out of ‘Survivor Series’ coverage.
Otunga and Hudson had been in a relationship since 2007 and were engaged since September 2008. They had their only child in August 2009.
